Under no circumstances, including, but not limited to, negligence, will Thinking Zebras Pediatric Therapy or affiliates be liable for any direct, indirect, incidental, special or consequential damages that result from the use of, or the inability to use this site, including its materials, products, or services, or third-party materials, products, or services made available through this site, even if we are advised beforehand of the possibility of such damages. You specifically acknowledge and agree that we are not liable for any defamatory, offensive or illegal conduct of any user.
Indemnity
You agree to defend, indemnify and hold Thinking Zebras Pediatric Therapy & its members, employees, and owner harmless from and against any and all losses, claims, suits, actions, liabilities, obligations, costs and expenses (including legal/ attorney fees and expenses) which it suffers as a result of third-party claims based on: (i) your negligence or intentional misconduct, (ii) your breach of any provision of the Terms of Use (including representation or warranty); (iii) materials prepared or provided by you including, but not limited to, any claims of infringement, or misappropriation of copyright, trademark, patent, or other intellectual property or proprietary right, infringement of the rights of privacy or publicity, or defamation or libel; or (iv) death, personal injury, or property damage arising out of, or relating to, your obligations hereunder.
